The Independent Centre for Data Protection Schleswig-Holstein (ULD) has been advocating “data protection by design” for decades. Until now, concepts for innovative data protection technology were mainly found in academic papers. Even though the General Data Protection Regulation calls for “data protection by design”, relevant concepts have rarely found their way into practice. When it comes to a so-called “Contact Tracing App”, “data protection by design” is possible - and essential.
„Datenschutz by Design“ – dafür setzt sich das Unabhängige Landeszentrum für Datenschutz Schleswig-Holstein (ULD) seit Jahrzehnten ein. Bisher waren Konzepte für innovative Datenschutztechnik hauptsächlich in akademischen Papieren zu finden. Obwohl die Datenschutz-Grundverordnung „Datenschutz durch Technikgestaltung“ fordert, finden die Ideen bisher nur selten den Weg in die Praxis. Für die Contact-Tracing-App ist „Datenschutz by Design“ möglich – und auch nötig.

Ab heute lässt Apple in Deutschland Autos mit auf dem Dach montierter Kamera fahren, mit denen Straßenansichten und Gebäudefronten aufgenommen werden. Schleswig-Holstein ist wohl noch nicht von Tag 1 mit dabei, sondern erst in einigen Monaten. Beim Unabhängigen Landeszentrum für Datenschutz Schleswig-Holstein (ULD) melden sich aber jetzt schon viele besorgte Bürgerinnen und Bürger.

The risk of WiFi Tracking has been well recognized. New trends in the automotive industry promise a rapid growth of the number of mobile access points (and thus affected data subjects). While tracking of WiFi-users has been recognized as high potential risk, the risk has already been realized at large scale today for users of mobile access points. In particular, two major location services are already operational today across Europe and systematically report the locations of a large percentage of mobile access points to central collection points controlled by entities outside of Europe. Considering the high data protection risk inherent in location tracking of individuals, this raises the need for mitigation to new levels of urgency.
